- Abstract
The article discusses the origins of regulatory commissions in the late 19th and early 20th centuries, which were intended to replace the role of juries in making decisions under new railroad laws in the U.S. It mentions that the creation of the administrative state upset constitutional structures supporting trial by jury, and to displace the jury, regulatory commissions had the power to issue orders for changing future railroad rates.
