- Abstract
The article presents the authors view concerning the fairness and the interest of decision of the case of Dragomir Milošević. He is not satisfied to the interpretation of fairness in the context of Milošević's case since the right of defense is altered. He states that the International Criminal Tribunal for the Former Yugoslavia (ICTY) Trial Chamber should not put much emphasis on the right of a fair trial since there is nothing unfair of Milo šević's choice of self-representation at the expense of his health condition. He reflects to the decision of the Trials Chamber and Appeals Chamber as unsatisfactory since both decisions are flawed in its legal analysis and proposes a solution which in practice is not capable of being carried out.
