- Abstract
The article discusses the challenges faced by individuals with severe mental illness (SMI) in California when it comes to obtaining emergency mental health treatment and the impact of California's community property laws on marriages affected by SMI. It highlights the inadequate existing legal pathways for obtaining mental health treatment and the deficiencies in California's community property system. The article argues for a novel equitable solution to protect mentally ill individuals from financially driven divorce. It emphasizes the need for better laws and support for individuals with SMI and their families.
