- Abstract
The article provides a further analysis of the constitutionality of the antitakeover statute of Delaware. It concludes that the constitutionality of the statute is no longer valid based on the empirical evidence presented by the authors. It says that federal courts uphold the statute on different grounds. It also includes replies to a symposium's participants, including Eileen Nugent, Joe Grundfest and Skadden Arps, regarding the statute's constitutionality.
