- Abstract
The article discusses the case "Middlesex Insurance Co. v. Castellano" dealing with an arbitrator's award of uninsured motorists benefits. Plaintiff Anthony Castellano sustained injuries when a motorcycle on which he was a passenger was involved in a hit-and run collision with a car. After exhausting the uninsured motorist coverage on his automobile liability, Castellano sought uninsured motorist benefits from the automobile liability issued by Middlesex Insurance Co. to his father and sister. The insurance company denied coverage. The arbitrator found that Castellano was covered person under the policies and awarded him uninsured motorist benefits. The court found that the contract definition limiting coverages to a resident relative who does not own a car does not violate the public policy embodied in uninsured motorist laws. Consequently, an arbitrator's award of uninsured motorists benefits under such a policy lo a resident relative who owns a car must be vacated. Because Castellano owns a car, he is not a covered person under the policies issued to his father and sister by the insurance company.
