- Title
VACATUR OF AWARD -- UNINSURED MOTORIST CLAIM -- SCOPE OF SUBMISSION -- COLORADO.
- Abstract
This article focuses on the judicial decision made against the case "International Service Ins. Co. v. Ross, 457 P.2d 917," concerning the laws related to uninsured motorist claims. The Appellate Court of Colorado, reportedly, had reversed lower court granting summary judgment on the second award in a case, after the first award denying the claim was reversed and remanded, the higher court holding that the court below had erred in its ruling. In reversing summary judgment order and remanding case, court found that there were issues as to whether the first award should have been confirmed insofar as there was no real showing of misconduct of the arbitrator warranting vacatur and there was a question of fact regarding which issues had been submitted to the arbitrator.
