- Abstract
The article discusses the legal aspects of DNA testing in America's criminal justice system as of 2015, and it mentions the legal rights of individuals such as arrestees, a balancing test for reasonableness under the Fourth Amendment to the U.S. Constitution, and the use of DNA evidence in criminal prosecutions. A presumption of innocence is mentioned, along with U.S. constitutional protections and the case Maryland v. King which deals with arrestees' DNA tests. Privacy rights are examined.
