The article considers the conflict between legal accountability and social responsibility in Canadian law. The cases implicating Canadian mining company HudBay Minerals Inc. and its subsidiary, HMI Nickel Inc., in serious human rights abuses in Guatemala is elaborated as an example. The lagging human rights enforcement mechanisms and lack of legislation thereof due to the indifference of the Canadian public and the resistance from the mining industry are also discussed.
