- Abstract
The article discusses the history of International Criminal Law (ICL) prior to World War II (WWII) and argues that penal action against violators of the laws of war featured non-negligibility, a consistent application of transnational doctrine, and the international quality of the forums that tried violators. It also discusses the concept of international jurisdiction, the modern state conception of criminal justice, and positivism. The article also examines the reliance of ICL on outlawry.
