- Abstract
With the dramatic increase in401 (k) plans over the past decade, plan sponsors, with the aid of their advisors, are asking more sophisticated questions about their obligations and responsibilities as fiduciaries. These questions are especially important in light of proposed regulations under Section 404(c) of ERISA (Employee Retirement Income Security Act of 1974). This article focuses on these impending regulations and compliance criteria, including the prudent selection of investment options, the use of pooled investment accounts, and the ability to transfer funds. The article also looks at the use of bundled and unbundled providers.
