- Abstract
The article presents legal developments in marketing with particular focus on the regulation of unfair competition. One of the developments describe the case of the United States v. American Pharmaceutical Association and Michigan State Pharmaceutical Association. This case reinforces the fact that professional associations are barred from imposing advertising restraints on pharmacists. However, lobbying by the associations to limit certain types of advertising is permitted. Another development discusses the case of the United States v. Reader's Digest Association Inc., in which the court found that each individual mailing that is part of a bulk mailing that contained elements which violated a U.S. Federal Trade Commission consent order constitutes a separate violation.
