- Abstract
The article presents information on legal developments in marketing relative to the regulation of price competition. In regard to price competition, the article discusses U.S. Supreme Court case Great Atlantic and Pacific Tea Co. (A&P), v. Federal Trade Commission (FTC) and the applicability and interpretation of the Robinson-Patman Act's "meeting competition" defense. The article chronicles the history of the case, which began in 1965. The article discusses the competition-friendly decision made by the Court. In regard to price control, the article discusses Alfred H. Hardwick v Nu-Way Oil Company, Inc. & Billy Delp and the conditions under which the manufacturer/supplier may fix retail prices and raises questions as to the level of independence of the retailer.
