- Abstract
The article discusses the costs of climate change and judicial federalism issues in the U.S. by analyzing the case City of Oakland v. BP PLC. In the case, the U.S. Ninth Circuit ruled that state common law tort cases should be tried in state courts rather than federal courts. In the case, the plaintiffs alleged that the defendants exacerbated climate change to become a public nuisance and sought compensation due to their climate change-based injuries.
