The article examines a sense of equity in environmental justice litigation in the U.S. by presenting the cases Juliana v. U.S. and Native Village of Kivalina v. ExxonMobil Corp. Also cited are the justiciability doctrine, the duty of government under public trust doctrine, and the rhetoric of Chaim Perelman on how to analyze said litigation and the procedure for the adjudication of legal disputes.
