- Abstract
The article discusses potential hindsight bias in relation to the nonobviousness requirement (NOR) under the U.S. patent laws as of September 2012, focusing on a historical overview of the NOR, including information on the codification of the NOR in Section 103 of America's 1952 Patent Act. Technological advancement is addressed in relation to the NOR and the originality of inventions. The U.S. Supreme Court's ruling in the NOR case KSR International Co. u. Teleflex Inc. is also examined.
