- Abstract
The general objective of this article is to investigate whether the CNJ's Trial Protocol with a Gender Perspective can be part of an institutional response to the structural gender inequalities that also cross the judiciary and which are aggravated by the intersectionality of other social markers that overlap., specifically when entering the judiciary. This is an exploratory research, with a bibliographic and documentary research method. The result points to a misogynistic rationality that specifies and reinforces gender stereotypes and that also crosses the judiciary, reflecting on legal demands even when they are not explicitly about gender. Therefore, the Judgment Protocol can potentially serve as part of an institutional response to clarify the role of the Judiciary through the recognition and mitigation of inequalities, with effects on the performance, interpretation, application and production of the Law. The relevance of this work is justified not only by the international parameters that guided the formalization of the Protocol, but especially by its proposal to recognize and deal with gender issues that cut across judicial procedures. Considering that the application of the Protocol became mandatory in March 2023, its recency reinforces the originality and originality of the theme.
