- Abstract
To non-habitual relationships between men and women that can't marry, called "concubinate" by the Brazilian Civil Code, rights conferred to familiar entities (sucessory rights, alimentary rights, etc.) and also the own condition of familiar entity itself, for many people, is not recognized. It is seen as marginal condition to the group that includes the marriage, the stablish union and other familiar entities. This marginal condition extends to those ones who keep love relationships with condemned of murder or trying to murder that person's husband, wife or companion. The axiology of this matter is not being questioned. Although, it had not been fixed a period to this impediment, what makes it a perpetual punishment, something considered unconstitutional, as it is exposed when deeply analyzed.
