The article focuses on the decision of the U.S. Court of Appeals for the Third Circuit in the case FTC v. Wyndham Worldwide Corp. which uphold the U.S. Federal Trade Commission (FTC) authority to challenge corporate data security practices as unfair or deceptive. It mentions that constitutional due process requirements and the history of FTC data security enforcement efforts and need to meet fair notice of the security standards.
