- Abstract
The article discusses the court case, 01051 Telecom GmbH v Deutsche Telekom AG, wherein the former claimed interest for late payments from the latter. The referring court, the Oberlandesgericht Köln, noted a discrepancy in the interconnection agreement between the two telecommunication firms, thus, deciding that such absence of a contract, default rules of the national law would apply. Oberlandesgericht Köln refer the case to the European Court of Justice for a preliminary ruling.
