- Title
ABSOLUTE INCOMPETENCE OF A TRIBUNAL Decision coram Defilippi, 30.XI.2000.
- Abstract
The article discusses a court case wherein a priest was accused of alleged homosexuality and was penalized by suspension by a bishop in 1996. The accused appealed against the decision before the Congregation of the Clergy, citing procedural lapses and denial of right of defense. The bishop's decision was nullified by the Congregation in 1997. An appeal by the bishop to a tribunal in March 1999 affirmed the suspension. The accused again appealed and the Tribunal of the Roman Rota decided in 2000 for the accused, citing incompetence of a tribunal in 1999.
