- Abstract
The article discusses the proper approach that should be adopted by the U.S. federal circuits in deciding the drug quantity to establish the mandatory minimum sentence for an individual convicted of conspiracy to distribute a controlled substance. It discusses the United States v. Stoddard case, the federal drug offenses, and the federal conspiracy statute. It concludes that all circuits must adopt the individualized approach as it is supported by precedential case law and firm policy reasons.
