- Abstract
The article discusses the author's contention that the U.S. constitutional limitations on punitive (exemplary) damages are inconsistent with the stated goals of the damages, and it examines the U.S. Supreme Court's ruling in the case State Farm Mutual Automobile Insurance Co. v. Campbell which deals with the court's imposition of a cap on punitive damages. The law and economics of deterrence are mentioned, along with problems involving juries, civil penalties, and monetary awards in America.
