The article examines the legality of monitoring the electronic communications of employees by employers in public sector in the U.S. Topics discussed include limitations on warrantless searches and seizures pursuant to the Fourth Amendment of the U.S. Constitution; cases and statutes that define the legal framework within which New York public employers monitor employee; employer's duty to negotiate when it comes to employee surveillance; and the Fair Credit Reporting Act.
