- Abstract
The article "The Civil Servant in the Social People's State" by Hermann Heller discusses the role of the civil servant in the social people's state. The author argues that the ambiguity and uncertainty regarding the role of civil servants can pose serious dangers to the professional civil service. Nevertheless, the necessity of a professional civil service is generally recognized even in a democracy. It is emphasized that the separation between political leadership and bureaucracy must be clearly drawn in order to safeguard the political rights that the parliamentary state has granted to the bureaucracy. It is suggested that the public-law civil service should be replaced by a different regulation.
