- Abstract
The article presents decisions by national courts in Europe. In the case of AstraZeneca vs. CGU International Insurance, the English Court of Appeal has clarified its jurisdiction to review High Court decisions on points of law under § 69 of the Arbitration Act 1996. The Swiss Federal Tribunal has ruled that an arbitrator who serves with the same counsel in multiple unrelated arbitrations is not considered biased unless concrete proof is presented indicating the arbitrator is not impartial. The Belgian Supreme Court has quashed a decision by the Commercial Court that an arbitration clause must be enforced even if arbitration is governed by a foreign law that does not allow particular disputes to be arbitrated.
