- Title
REGULATORY COMPETITION, CHOICE OF FORUM, AND DELAWARE'S STAKE IN CORPORATE LAW.
- Authors
Stevelman, Faith
- Abstract
The article focuses on the credibility of the corporate law in Delaware. It highlights the threat from federal law and the out-of-state adjudication of corporate law cases which will affect the preeminence of such law. The threat has been interpreted to limit its freedom to craft corporate legal standards which may affect the distinctness of its corporate law. As a result, this may question the integrity and preeminence of the corporate law. Moreover, New York has been perceived to manage the high profile corporate cases left by the state courts of Delaware.
