The article focuses on how management-side employment lawyers must prepare for the U.S. Supreme Court rulings in class-action waivers controversy. Topics include consequences of the issue on the relationship between business and individual rights; the role of National Labor Relations Act of 1935 in offering remedy for inequality of bargaining power between employees and employers; and longstanding judicial hostility to arbitration agreements.
