- Title
The OAS and the UNCITRAL Model Laws on Secured Transactions compared.
- Authors
Bazinas, Spyridon V.
- Abstract
This article generally compares and briefly describes the UNCITRAL Model Law on Secured Transactions and the Model Inter-American Law on Secured Transactions. It identifies the common characteristics and the differences between these two texts. And finds that, as a matter of fact, the UNCITRAL Model Law is a more recent text, prepared by an international (not regional) organization and is in many respects more complete than the OAS Model Law (for example, has complete conflict-of-laws and transition chapters, and comes with other texts that deal, inter alia, with the extremely important issue of the treatment of security interests in insolvency).
