- Abstract
The paper discusses problems associated with a concept of mental health care completely waiving the use of coercive measures (as described by Zinkler and von Peter in Recht und Psychiatrie 2019; 37 [4]: 203 -- 209). Apart from considerable organizational, human resources related und economic problems which would have to be solved while implementing such a concept, we are particularly concerned by the concept-inherent continuation of police custody for persons who refuse psychiatric/psychosocial care, however present with an acute mental disorder associated with significant and persisting violent behaviour at risk for themselves and/or others. From our perspective, it is ethically questionable to categorically withhold potentially successful treatment from persons with mental disorders and specific features of risk and thereby accept potentially longer lasting measures in police custody just because they refuse such a treatment. Numerous central questions regarding the care of persons with mental disorders remain unanswered in such a concept of mental heal care.
