- Abstract
This article illustrates how, despite being well-established, having a consistent record with passing time and achieving sophisticated results, the attention paid by labour lawyers to the forms of organisation adopted by private entrepreneurs now appears to have been caught off balance by those entrepreneurs' transnational dimensions. More precisely, the article sets out to show how the crucial role played by national legislation and the individual protection of employees, which is still recognised by the culture of labour law today, all too often leads to the a situation that tends to ignore other lines of thinking, such as, primarily, the one relative to supporting and consolidating collective relations in the context of the power dynamics at work inside multinational entrepreneurial conglomerations. Hence, therefore, the need for labour lawyers to build the legal foundations crucial for strengthening transnational manifestations of collective independence, thus also contributing to the social legitimation of this perspective.
