- Abstract
The article discusses testimonial privileges in conflict of laws which may provide laboratory conditions for the construction of choice-of-law rules or a choice-of-law approach. According to the article, the protection of privacy is a policy which may have played a role in the creation of some privileges and may be responsible for their continued existence. It cites an example to strengthen the argument that on occasion privileges may be recognized for policy reasons that are of special concern to the state of trial. A discussion on the situation where the question of the applicability of a particular privilege is raised at the trial is given.
