- Abstract
The article discusses the constitutional right to a fair trial in the U.S. as of April 2012, focusing on the Missouri Supreme Court's ruling in the case Fleshner v. Pepose Vision Institute which deals with an exception to the Mansfield Rule on juror testimony in cases involving overt racial, religious, or ethnic comments made during juror deliberations. The author argues that the court in Fleshner erred in carving out an exception for certain forms of bias.
