- Abstract
The present paper deals with a current issue, namely the role of the magistrate in society, a problem that seems simple when trying to offer a didactic definition, but things become more complex in the attempt to define a definition of this notion. Since the earliest times, the role of the magistrate in society has been particularly important and consisted of solving conflicts of any kind, carrying out the act of justice, achieving justice in a non-discriminatory manner, all of which have the main objective of ensuring the rule of law. From the magistrates, the justifiable has always waited for his answer to his need for justice, the right handling of his cause and, most importantly, he did not accept errors, because for the justifiable the magistrate is no longer a simple man but an institution that will righteously share justice. The basis for determining and exercising the role of the magistrate in society is a series of criteria, including the legal aspect, the moral aspect and the human aspect. Respecting these aspects strengthens the trust of the justifiable in the magistrates and the rule of law and at the same time strengthens the role of the magistrate in society. Regardless of the country, each having a legal system with certain specific features, the role of the magistrate in society resides in defending the interests of society, the rights and freedoms of citizens, ensuring and maintaining an order of law by applying the legal and constitutional provisions, the result being the implementation of the act of justice and the realization of justice.
