- Abstract
The article discusses developments in health law in the U.S. as of August 2008 in relation to the U.S. Supreme Court case "Riegel v. Medtronic." In February 2008, the Supreme Court agreed with the Food and Drug Administration (FDA) position that the Food, Drug and Cosmetic Act (FDCA) pre-empts state tort claims against the makers of medical devices that are subject to FDA pre-market approval.
