- Abstract
The article discusses a court case wherein the a three-judge panel of the Ontario Court of Appeals overturned a number of rulings by a motions judge in a suit brought against the administrator of the Ontario Municipal Employees Retirement System (OMERS), and certain service providers, on behalf of all OMERS plan beneficiaries. The Court of Appeal's ruling did not make any findings of fact but is significant enough for allowing some uncommon legal claims to go to trial. The facts of the case are presented.
