- Abstract
The article focuses on the resolution of the legal case of the Navajo Nation vs. the United States. In the case the Court of Appeals held that the Surface Mining Control and Reclamation Act of 1977 (SMCRA) made the federal government responsible for providing representation for Indian tribes in matters relating to mining operations on Indian lands and that the SMCRA and its implementing regulations created jurisdiction under the Indian Tucker Act.
