- Abstract
Family diversity is a changing reality that is increasing year by year, acquiring new identities, profiles and social needs, which is why public policies, and an adequate legal framework must be implemented to respond to this social reality, to which this collective of single-parent family belongs. This has some sociodemographic characteristics that place him in a scenario of possible social exclusion, this situation being aggravated when the single parent is a woman, which is the most common situation. Due to the discrepancies between the different autonomous communities in Spain, as well as the resolutions of the Superior Courts of Justice of them, the Supreme Court has recently ruled unifying doctrine, in its Judgement No. 167/2023, of 27 February, alleging that in Spain there is an absence of a legal framework that protects this group and that determines the benefits or permits to which single-parent families are entitled, considering the interest of the minor and avoiding in any case, situations of discrimination against this group.
