- Abstract
The article discusses a right of rescission in America under the nation's Truth in Lending Act (TILA) which was passed by the U.S. Congress in 1968, and it mentions issues related to the provision of clear and conspicuous notice and electing not to rescind a transaction. Creditors' disclosure obligations are addressed, along with the 1998 U.S. Supreme Court case Beach v. Ocwen Federal Bank which deals with consumer rights and recoupment. Timing and American loan laws are also examined.
