- Abstract
This study aims to identify the constitutionality of the local decentralization councils in Jordan. To achieve this objective, the study has utilized the analytical descriptive method. It clarifies the concept of the local decentralization system and distinguishes it from the federal political decentralization system. The Jordanian Constitution and the Jordanian Decentralization Law No (49) of 2015 have been analyzed in order to show how the Jordanian Constitutional Court sees the local decentralization system in Jordan. The results reveal that the Jordanian Decentralization Law is constitutionally based on Article (121) of the constitution. However, the results also reveal that the Jordanian Decentralization Law is only constitutional by form but not by content. Finally, the study recommends that the Jordanian Decentralization Law be amended in content in accordance with the Jordanian Constitution.
