- Abstract
The article examines several legal aspects of the right to be forgotten (RTBF) directive of the European Union which enables claimants to request the removal of personal Internet information about them, from the perspective of tort law. Topics covered include impact of First Amendment protections on remedy against the perpetrator of non-defamatory fake news, why the RTBF is untenable under U.S. law and assessment of the RTBF in the context of the economics of market failure.
