- Abstract
The article discusses a court case wherein Mac's Shell Service Inc. claimed for constructive termination under the Petroleum Marketing Practices Act (PMPA), against Shell Oil Products U.S. It states that the U.S. Supreme Court reversed the First Circuit's decision, and stated that there can be no claim for constructive termination under PMPA, where franchisee remains in business. It mentions that constructive termination claims are recognized in analogous areas of law, like employment law.
