The article is in response to a symposium on the case McCleskey v. Kemp. It draws a parallel between McCleskey v. Kemp and Plessy v. Ferguson focusing on the ethical issue of racial discrimination in trials. It presents facts and opinions from each case and points out the shortcomings of the verdicts reached.
