- Abstract
The article discusses legal issues in the software development industry in the U.S., particularly on the need to apply a professional malpractice standard to software developers. Also cited are functionalist theory of professionalization focused on customary care standard and professional judgment, the proposed three-factor test to determine the appropriateness of customary care standard, and why software should be considered as profession like medicine or law.
