The author argues that the Queensland legal requirement to seek consent to withdraw or withhold futile treatments is the futility assessment method. He cites a problem with the concept of futility and some approaches to defining futility, including quantitative, qualitative and physiological. He suggests adopting a procedural approach based on clinical consensus as a way to deal with determination of futility.
