SIMILAR FACT EVIDENCE IN CIVIL PROCEEDINGS: PROOF OR POLICY.
- Authors
Robertson, Bernard; Wheatley, Amelia
- Abstract
The article discusses issues related to considering the admissibility of similar fact evidence in civil cases although the overwhelming majority of similar fact cases are criminal cases. The term "similar fact evidence" refers to evidence relating to incidence which are not the basis of the charge or the statement of claim but which are said to be relevant to the proof of the facts charged or alleged. The lack of special rules relating to similar fact evidence in civil cases in Australia, England and New Zealand is also cited.
