- Title
EuGH: Voraussetzungen für nationales Verbot eines Online-Dienstes für rezeptfreie Arzneimittel.
- Abstract
The European Court of Justice (ECJ) has ruled that an online service that sells non-prescription drugs through pharmacy websites is considered a "service of the information society." Member states can prohibit the provision of such a service if the provider sells drugs without being authorized to do so. The ECJ's judgment confirmed the legality of a national ban in such cases. Reference is also made to a judgment of the Higher Regional Court of Cologne regarding the design of cookie banners, which states that a cookie banner without a rejection option and with a consent button cannot be considered as voluntary and sufficiently informed consent.
