The article discusses the author's claim that the common law treatment of digital photography-related metadata in America needs to evolve as of 2016, and it mentions the legal aspects of electronically stored information (ESI), as well as the legal discovery process involving photographic evidence, and the U.S. Federal Rules of Civil Procedure and Federal Rules of Evidence. America's silent witness doctrine is examined, along with advances involving cell phone cameras and digital cameras.
