- Abstract
The article discusses the approaches for achieving a resolution to intractable medical futility disputes in the U.S. It explores the characteristics and prevalence of this kind of disputes and examine the role of surrogates in representing the preferences and interests of the patients, particularly in deciding the type of medical treatments. Moreover, it also analyzes the viability of surrogate replacement as a mechanism of dispute resolution, and argues that surrogate selection only serves as a partial solution to futility disputes.
