- Abstract
In the study, the relationship between water pollution and the right to water is explained by looking at water pollution from the perspective of water right, which is one of the environmental rights. Since it is impossible for people who do not know their rights to defend these rights, it is explained that everyone has the right to access water, and therefore people who cannot access clean water can get their rights through legal means. Water pollution negatively affects every area, from the health of living things to the economic situation of the country. The study aims to lay the groundwork for policies to be created to prevent water pollution by documenting that access to clean water is a legal right. There are many provinces in Turkey that are exposed to water pollution and cannot benefit from the right to water. However, the place where this situation is seen most concretely is Burdur. The fact that even the running water in the kitchen is not clean proves this. For this reason, Burdur, the province where water pollution is most intense and frequent, was chosen as the subject of the study. Although there are studies addressing water pollution in the literature, there is no study looking at water pollution from the perspective of the right to water, which is one of the environmental rights. The study is important and necessary because it contributes to studies that will be created by looking at water from a different perspective. Since prevention is less costly than repair, it is suggested that the main purpose of the policies to be created should be preventing pollution, not purifying water. The study concludes that the right to water, which is one of the environmental rights, should be rearranged to form an integrity with water problems, and a reward system should be adopted rather than a penalty system to prevent water pollution.
