- Abstract
After democratic transition in Spain, in the 1970s, teaching of religion in school has raised a number of issues, not always well addressed by Spanish law, both in the realms of public school and private school. Among other issues, we could mention the following. With respect to confessional teaching of Catholic religion in public schools, the issue of the legal status of religion teachers has generated some uncertainties about the margin of discretion of ecclesiastical authorities when they decide not to renew the teaching permit (venia docendi) to religion teachers for reasons related not to their academic competence but rather to their private moral misconduct. Also the confessional teaching of minority religions has raised important legal issues, especially from the perspective of the equality principle: is the principle of proportionality respected vis-à-vis the teaching of Catholic religion?, is it appropriate that law reserves confessional teaching exclusively to those religions that have a cooperation agreement with the State? (particularly taking into account the reluctance of all Spanish governments to sign new agreements after 1992). Other controversial issues have been the possibility to include non-confessional teaching of religion in public schools, and the compulsory character of confessional religious teaching in private religious schools funded with public money.
